MuZiKa Records — Terms and Conditions

Please read these Terms and Conditions (“Terms”) carefully. By accessing or using muzika-records.com (the “Site”) or any services provided by MuZiKa Records (“MuZiKa,” “we,” “us,” or “our”), you agree to be bound by these Terms. If you do not agree, do not use the Site or our services.
1. Scope
• These Terms govern your use of the Site and any services offered through it, including music sales, streaming links, merchandise, ticketing, newsletters, artist/demo submissions, promotional services, and any other online services (collectively, “Services”).
2. Eligibility
• You must be at least 16 years old (or the minimum age required by local law; if under the minimum you must have parental/guardian consent) and able to enter legally binding contracts to use the Site and Services.
3. Accounts, Registration & Security
• Account information: To use certain Services you may need to register and provide accurate, current and complete information. You are responsible for maintaining the confidentiality of your account credentials.
• Responsibility: You are responsible for all activity under your account. Notify us immediately of any unauthorized use.
• Termination: We may suspend or terminate accounts for violations of these Terms or for any other reason with or without notice.
4. Artist Submissions and Demo Policy
• License to review: By submitting demos, recordings, lyrics, videos, biographies, photos, or other materials (“Submissions”), you grant MuZiKa a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, distribute, perform, display and otherwise exploit the Submissions solely for evaluation, promotion, portfolio or business operations related to MuZiKa’s activities.
• No confidentiality: Unless otherwise agreed in writing, submissions are not confidential.
• Originality and rights: You represent and warrant that you own or control all rights in the Submission and have the right to grant the license above, and that the Submission does not infringe any third-party rights.
• No obligation: Submission does not create an obligation for MuZiKa to sign, pay, or produce you.
• Removal requests: Contact INFO@muzikarecords.com to request deletion of your Submission; we may retain copies for legal or administrative purposes as described in our Privacy Policy.
5. Purchases, Payments & Refunds
• Payment processing: Payments are processed by third-party payment processors. You agree to provide valid payment information and to pay all fees.
• Pricing & taxes: Prices are as listed on the Site. You are responsible for applicable taxes, duties, and fees.
• Refunds: Refund policies vary by product or service. Check the specific product page. We reserve the right to refuse or cancel orders for any reason, including suspected fraud.
6. Intellectual Property
• Our content: All Site content (design, text, graphics, logos, images, audio, video, software) is owned or licensed by MuZiKa and protected by copyright, trademark and other laws. You may not copy, reproduce or use our content except as expressly permitted.
• Your content: By posting or submitting content you grant MuZiKa the rights described in the Artist Submissions section or, for user-generated content, a non-exclusive license to use such content to provide the Services and promote the Site, as permitted by the settings you choose.
• Trademarks: “MuZiKa,” and other trademarks, service marks, and logos are our property. Do not use them without express written permission.
7. User Conduct
You agree not to:
• Violate any laws, infringe third-party rights, or upload malicious code.
• Post false, defamatory, obscene, or infringing content.
• Harass, stalk, threaten, or otherwise harm others.
• Use the Site to distribute unsolicited advertising (spam).
• Attempt to access other users’ accounts or restricted portions of the Site.
8. DMCA and Copyright Infringement
• If you believe your copyrighted work has been used in a way that constitutes infringement, follow the procedure in our Copyright Notice (contact details below). We will respond to valid notices and may terminate repeat infringers.
9. Disclaimers
• No guarantees: The Site and Services are provided “as is” and “as available.” We make no guarantees regarding the availability, accuracy, completeness or suitability of any content or Services.
• No promise of success: We make no promises that use of the Site or Services will lead to career advancement, contracts, or commercial success.
10. Limitation of Liability
• To the fullest extent permitted by law, MuZiKa and its affiliates, officers, directors, employees and agents will not be liable for indirect, incidental, special, consequential, punitive or exemplary damages, or lost profits, revenue, data, or use, arising from or related to your use of the Site or Services, even if advised of the possibility of such damages. Our aggregate liability for direct damages will not exceed the amount you paid to us in the 12 months preceding the claim (or $100 if you have not paid for Services).
